This Rent Protection and Legal Costs Insurance is designed to cover landlords wishing to protect themselves against non-paying tenants and associated costs to remove the tenant from the rented property if applicable.

Eligibility

Eligibility for Rent Protection & Legal Costs Insurance

  • Each tenant and any guarantor must been referenced in accordance with the policy terms & conditions.
  • The tenancy agreement must start no more than 60 days after the tenant reference pass date.
  • The tenancy agreement must not have started before the tenant reference pass date.
  • Your property is let under an Assured Shorthold, Company Residential (Company Let) or a written Common Law Tenancy Agreement for a fixed term no greater than 24 months.
  • Tenancy Agreements greater than 12 months must contain a 12 month break clause.

Our Rent Protection and Legal Costs Insurance policy has been designed to compliment a tenant reference from Keysafe Tenant Vetting that has been issued with a pass rating. (other tenant referencing companies may be acceptable, for more information please see the FAQs section on this page.

Each tenant and any guarantor named in the tenancy agreement must be successfully referenced. If you haven’t referenced your tenants (or guarantor if applicable) then please see the Tenant Referencing section on this website for further details of the referencing service offered by Keysafe Tenant Vetting.

If a prospective tenant is passed with recommendations i.e. a higher deposit is collected or a guarantor is assigned to the agreement, these recommendations must be complied with to validate cover.

Do I have to use Keysafe Tenant Vetting to reference my tenant(s)?

The premiums quoted above include Insurance Premium Tax (IPT) of 6% which applies to insurance policies instead of VAT. They do not include the cost of tenant referencing for which you are responsible.

Making a claim

How to make a claim

Our aim is to provide an excellent claims service at all times. Subject to your claim form and supporting documentation being submitted to the claims team within 45 days of the insured event, the legal team will take over and attempt to resolve the issues with your tenant(s) or arrange eviction proceedings if necessary.

The insurer will decline any claim where the claim form and supporting documentation has not been returned within 45 days of the dispute / default.

The Insured or his agent should telephone 0844 770 1079. A claim form will be sent out by e-mail, fax or post within 24-hours. The claim form is required to be completed and returned to Arc Legal directly along with supporting documentation within forty five days of the insured event.

It is recommended that you use a tenant referencing company but it is not essential. You must be able to provide all of the following in the event of a claim:

  • Two forms of identification from the tenant, one of which must contain a clear photograph (such as a passport or driving licence).
  • A written employment reference on company headed paper confirming salary and continued employment status
  • A credit check confirming no outstanding County Court Judgements from any of the following companies:

Failure to provide evidence of the above referencing requirements to the claims department will invalidate your cover and no payments will be made.

Yes, you must obtain a credit check & relevant references for each and every tenant named in the Tenancy Agreement(s), including marital spouses. Any dispute with an occupant in the property that is not a named tenant and has not passed a tenant reference will not be covered under the insurance.

Rent arrears will be paid up to the expiry of the eviction notice (arranged by the claims department) up to the end of the policy or when vacant possession has been obtained, whichever event occurs first.

Ideally Yes. If the Tenancy Agreement commenced or was renewed more than 14 days prior to the start of the policy you cannot make a claim within the first 3 months of the policy.

Working Persons as long as the Tenancy Agreement is directly between landlord and tenant and the tenant has passed a tenant reference. Students and persons claiming DSS benefits are only acceptable if they have passed a tenant reference and are guaranteed (by way of a guarantor agreement correctly assigned to the Tenancy Agreement) by a person/organisation that has also passed a tenant reference.

Yes, however should you find damages to your property once vacant possession has been obtained, we will reduce the excess to 30 days and pay you rent arrears for the period from the 31st day to the end of the 6th week.

Tenants with CCJ’s are unacceptable for the legal and rent protection insurance but are fully acceptable for landlords emergency home assistance cover.
